Are crypto casinos legal for us players or are we kidding ourselves

Post by coldwallet_cole »

Honest question because I keep seeing people in here say "it's totally legal, crypto so they can't touch you." That's not what I read at all and I'd rather we be straight about it.

The way I understand it: these sites are offshore, Curacao or Anjouan licensed, and there's no federal law that targets you as an individual for wagering crypto on an offshore site. So the operator isn't legal in the US, but you sitting at home aren't the one breaking a federal statute either. Grey area.

State law is the part everyone skips. A few states are way more aggressive about online gambling than others, and "no federal law" does not mean your state agrees.

So what I'm asking is not "is it safe" really. It's: am I wrong about the state piece? Anyone actually looked into their own state instead of repeating the forum line?

You're not wrong, and I'll go further. The "crypto means anonymous so it's fine" thing is two separate ideas getting mashed together. Legality and traceability are not the same conversation.

I've played offshore for years. Never had a problem. But "I never had a problem" is not legal advice, it's just one guy's luck and my state being pretty quiet on it. Couple states I'd genuinely not touch it. Look yours up, don't take mine.

Mod hat on, lightly. We don't let "fully legal everywhere" stand because it isn't true and it gets people burned.

Framing I'm comfortable with: offshore grey area, no federal law aimed at the individual player, state law varies and some states matter a lot. That's it. If anyone wants certainty for their situation that's a lawyer in their state, not a casino forum. We're hobbyists, not counsel.

boh, people want a yes/no and there just isn't one. it's grey. you decide how much grey you're ok with.

the part that annoys me is the anonymity selling point doing double duty. a Curacao license is basically a rubber stamp and a no-kyc signup is just less paperwork at the door, neither of those is a legal shield. two different things people keep welding together.
